Built for Montreal's public sector and businesses

Emergency services in Montreal are organized across the whole agglomeration. The Service de sécurité incendie de Montréal (SIM) serves the agglomeration of Montreal, responding to fires, medical emergencies through firefighter first responders, and emergency measures. Urgences-santé provides pre-hospital emergency services to Montreal and Laval, operating its own health communication centre and ambulance service, where 9-1-1 calls are answered by emergency medical dispatchers. The SPVM works from 28 neighbourhood stations, a metro station and four operations centres.

Quebec records and privacy laws

Quebec has its own privacy laws for both the public and private sectors, so the federal private-sector law generally does not apply to businesses operating within Quebec. Law 25 strengthened both laws between 2022 and 2024, and a separate law now governs health and social services information. The Commission d'accès à l'information (CAI) oversees them.

Act respecting access to documents held by public bodies and the protection of personal information

Applies to the government, ministries and agencies, municipal bodies (including municipalities, metropolitan communities and public transit corporations), school bodies and health and social services institutions. The person with the highest authority in each body is responsible for access and for protecting personal information, and the CAI must be told who holds that role.

Who it affects: Quebec public bodies, including the City and its agencies.

Act respecting the protection of personal information in the private sector

Applies to personal information a business collects, holds, uses or communicates. A business must name a person in charge of protecting personal information, notify the CAI and the people affected of a privacy incident that presents a risk of serious injury, carry out privacy impact assessments for certain technology projects, and assess before communicating personal information outside Quebec.

Who it affects: businesses operating in Quebec.

Law 25 (Act to modernize legislative provisions as regards the protection of personal information)

Amended both acts above in three phases: September 22, 2022 (person in charge of personal information, mandatory incident reporting and an incident register), September 22, 2023 (mandatory privacy impact assessments and rules for communicating information outside Quebec) and September 2024 (the right to data portability).

Who it affects: Quebec public bodies and businesses.

Act respecting health and social services information

Most of its provisions came into force on July 1, 2024. It sets standards for protecting health and social services information held by the Ministry, Santé Québec and other institutions, their contracted service providers and certain professionals.

Who it affects: health and social services institutions and their service providers.

Archives Act

Every public body must establish and keep up to date a retention schedule (calendrier de conservation) that sets how long documents are kept and which are kept permanently or destroyed. Ministries and government agencies must have their schedule approved by Bibliothèque et Archives nationales du Québec (BAnQ).

Who it affects: Quebec public bodies, including municipalities.

How Datalynk supports these requirements. Datalynk keeps records in Canada, controls access by role, keeps a history of who created and changed each record, and can hold records for the retention periods you set. Meeting a law is still your organization's responsibility. Tell us which rules apply to you and we will show you how Datalynk would handle them, or tell you plainly where it would not.

This is general information about Quebec law, not legal advice. Check the current law and your own obligations with your legal or privacy advisor.
